Terms and Conditions of Use

These Terms and Conditions of Use (the “Terms”) are a contract between you and Altech Web Design Inc (“Altech Web Design”, “we” or “our”), located at 10890 NW 17th St, Miami, FL 33172, United States. They govern your use of our website, our AI website-building tools (including AI Classic Builder and AI Vibe Builder), hosting, AI automation services and any other service we offer (the “Services”).

By creating an account, starting a free trial, purchasing a plan or using the Services, you state that you have read and agree to these Terms, our Privacy Policy, our Cookie Policy and our Refund Policy. If you do not agree, do not use the Services.

1. Eligibility and account

  • You must be at least 18 years old and legally able to enter into a contract. If you act on behalf of a business, you state that you have authority to bind it.
  • You are responsible for the accuracy of your account information, for keeping your credentials confidential and for all activity under your account.
  • You must notify us immediately of any unauthorized use of your account.

2. 14-day free trial

  • The free trial lasts 14 days, requires no payment method and is limited to one per person, business or domain. We may change its length or withdraw it at any time.
  • When the trial ends, the customer dashboard is closed and your website is permanently deleted, with no possibility of recovery, unless you first purchase a paid plan.
  • During the trial the Services are provided “as is”, with no guarantee of availability or of content retention. It is your responsibility to keep a copy of anything you wish to save.

3. Paid plans, billing and renewal

  • Paid plans (for example, dynamic websites built with Vibe or with the classic AI editor and Elementor, with or without an Ecommerce store) are purchased through our online checkout and billed in advance, monthly, unless another period is stated.
  • Plans renew automatically at the end of each period and the payment method on file is charged until you cancel. By purchasing, you authorize these recurring charges.
  • You may cancel at any time from your dashboard or by writing to contact@altechwebdesign.com. Cancellation prevents future renewals and takes effect at the end of the period already paid; the service continues until then.
  • Prices may change with reasonable prior notice; the change applies from the next renewal.
  • You are responsible for applicable taxes. If a payment fails, we may suspend or limit access until it is resolved and, if non-payment continues, cancel the service and delete your content.
  • Refunds are governed by our Refund Policy.

4. AI-generated content

  • The Services use artificial intelligence to generate text, designs, structures and images from your prompts. Outputs may contain errors, be inaccurate or be similar to those generated for other users.
  • You are solely responsible for reviewing, editing and verifying all content before publishing it, including its accuracy, legality and suitability for your business. We do not provide legal, tax, medical or financial advice.
  • You state that your prompts and uploaded files do not infringe third-party rights or the law.

5. Your content and license

You keep ownership of the content you upload or publish (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process and display Your Content solely as needed to provide, protect and improve the Services. You warrant that you have all necessary rights in Your Content.

6. Acceptable use

You may not use the Services to:

  • Engage in illegal, fraudulent or deceptive activity, or infringe intellectual property, privacy or other rights of others.
  • Publish malware, phishing, spam, content that exploits minors, content that incites hatred or violence, or unlawful sexually explicit material.
  • Attempt unauthorized access to our systems or other accounts, interfere with the service, reverse engineer it or bypass technical limits.
  • Resell, sublicense or assign the Services without our written consent, or use them to train competing AI models.
  • Abusively overload the infrastructure, including through bots or denial-of-service attacks.

We may suspend or remove content or accounts that violate these rules, without prior notice when necessary to protect third parties or the Services.

7. Intellectual property

The Services, their software, trademarks, logos, designs, templates and documentation belong to Altech Web Design or its licensors and are protected by United States intellectual property laws and international treaties. These Terms grant you no rights other than a limited, revocable, non-exclusive, non-transferable license to use the Services in accordance with these Terms. If you send us feedback or suggestions, we may use them freely without obligation to you.

8. Third-party services

The Services may rely on, or link to, third-party services (for example, payment processors, domain providers, WordPress and its plugins, Elementor, or AI providers). Their use is subject to those third parties’ terms and we are not responsible for them.

9. Availability and changes

We strive for high availability but do not guarantee that the Services will be uninterrupted or error-free. We may perform maintenance, modify, add or remove features, and update these Terms. If a change is material, we will notify you by email or in the dashboard. Continued use of the Services after the effective date means you accept the change.

10. Suspension and termination

You may stop using the Services and cancel your plan at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, if required by law, or if your use poses a risk to the Services or third parties. On termination your right to use the Services ends and we may permanently delete Your Content after a reasonable period. Provisions that by their nature should survive will remain in effect.

11. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, ALTECH WEB DESIGN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTY AS TO THE ACCURACY OR RESULTS OF AI-GENERATED CONTENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALTECH WEB DESIGN, ITS OFFICERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, CUSTOMERS OR GOODWILL, ARISING FROM THE USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ALTECH WEB DESIGN IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so they may not apply to you.

13. Indemnification

You agree to defend, indemnify and hold harmless Altech Web Design, its affiliates, officers and employees from claims, damages, losses and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Services, your breach of these Terms, or your violation of third-party rights or the law.

14. Governing law, venue and dispute resolution

  • These Terms are governed by the laws of the State of Florida, United States, and applicable federal law, without regard to conflict-of-law rules.
  • Before starting any action, the parties will try to resolve the dispute in good faith by writing to legal@altechwebdesign.com and allowing 30 days.
  • Any legal action will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their personal jurisdiction and waive any objection to venue.
  • TO THE EXTENT PERMITTED BY LAW, YOU AND ALTECH WEB DESIGN WAIVE TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN CLASS OR REPRESENTATIVE ACTIONS; CLAIMS WILL BE RESOLVED ON AN INDIVIDUAL BASIS.
  • Any claim must be filed within one (1) year after the cause of action arose, unless applicable law provides a longer period that cannot be waived.

15. General provisions

  • Entire agreement: these Terms, together with the policies referenced herein, are the complete agreement between the parties.
  • Severability: if any provision is invalid, the rest remains in effect.
  • No waiver: failure to exercise a right is not a waiver of it.
  • Assignment: you may not assign these Terms without our consent; we may assign them in a merger, acquisition or sale of assets.
  • Force majeure: we are not liable for failures caused by events beyond our reasonable control.
  • Language: translations of these Terms may exist; in case of conflict, the English version prevails where available.
